Five days after charges in the Salt Lake City bribery case were dismissed, prosecutors filed a Notice of Appeal Tuesday with the 10th U.S. Circuit Court of Appeals in Denver.
The appeal could be considered at once by the Denver court, although it could take months for a ruling, keeping the case going through the Salt Lake Winter Games.
Prosecutors still need the solicitor general’s approval to proceed with the challenge.
Max Wheeler, one of the lawyers defending the two Salt Lake bid leaders indicted in the scandal, said the Justice Department has plenty of time to reconsider and drop the entire matter.
He said, “we’re still going to try to talk them out of it”.
